There have been tens of thousands of legal opinions written over the years, but in law school youââ¬â¢ll only read a small slice of cases. Why are those cases picked? They are chosen because of the way they illuminate issues -- the precise legal questions or conflicts whose resolutions end up shaping the development of the law. Identifying the issues that a case presents is perhaps the central skill youââ¬â¢ll learn in law school: they call law school exams ââ¬Å"issue spottersâ⬠for a reason. So what is a legal issue, exactly, and how do you identify it before that first cold-call? Here are my tips for identifying those legal issues. 1) Ignore the obvious. Generally, if two parties sign a written agreement with the word ââ¬Å"Contractâ⬠on it, itââ¬â¢s a contract. If a statute gives federal courts jurisdiction over a certain type of claim, they have jurisdiction. What makes cases interesting -- and fun -- is not the facts or claims that are easy to make, but the ones that are tricky. The issue is never a question that can be resolved with a simple, clear answer. 2) Look for ambiguity in the facts. Lawyers LOVE ambiguity. Itââ¬â¢s exactly what allows us to make arguments! There are some famous cases with straightforward facts -- where the intrigue comes exclusively from the legal principles at stake -- but just as often thereââ¬â¢s a question of how a generally accepted legal principle (equal protection, the tax-and-spend power, etc.) applies to a particular set of facts. Where thereââ¬â¢s something you donââ¬â¢t quite get in the facts, thereââ¬â¢s a nice legal issue lurking. 3) Find where the opinions disagree. Many cases you read in law school have dissenting opinions, precisely because these opinions help you see both sides of the contested legal or factual points. Dissents are great because they show you what both sides accept -- see above -- as well the points at which the judgesââ¬â¢ opinions diverge. When you invite someone to sit at your table and you want to cook for them, you re inviting a person into your life.â⬠Throughout the history of humans, food has been a constant in cultures, traditions and everyday life. People have evolutionized to crave food because it gives us the nutrients and minerals that are needed for survival. Interestingly, as things like transportation, shelter, warmth, health and ideology have changed over long periods of time to become more efficient, food has remained close to the same. The food that is given to humans today from the time they are a small child is quite similar to the food eaten hundreds and even thousands of years ago. From a young age I have always had a keen interest in monetary matters and have also been intrigued by legal systems and how they work. I feel that combining one or both of these interests with business management will give me a sound footing to launch a career from in either legal or financial business sectors. I am confident within myself and find communication with others easy. I want to study at university to deepen my understanding of the knowledge and skills I already have. I am currently on a gap year scheme called Year in Industry in which I have a years work placement with Centrax, an aerospace company based in Newton Abbot. This placement is giving me invaluable knowledge as to how industry really works, and has enabled me to learn how to work properly as part of a team and how to reach a common goal. I have been given a project to make the company paperless. This involves studying workflow and analyzing current systems of work. There is a good chance that I will gain sponsorship from my company for university. In my spare time I enjoy keeping fit. I go to the gym and play sports including tennis and football. I am keen on all aspects of modern technology and can program fluently in Delphi. Whilst at school I had percussion lessons and I reached grade 4 standard, I was also on the student council. However towards the end of school I suffered a serious illness which forced me to miss a large amount of my final 2 years. Despite missing much of those final 2 years I still achieved more than enough GCSE A to C grades to get into the college course I desired. I have now made a full recovery. In the future I would like to see my self working in such areas as the stock exchange or a business focusing on legal issues, such as contracts as this would interest me a great deal. .
